1. What these terms cover

These terms cover the current informational website and its downloads. Ask Fifty, memberships, paid products and a newsletter subscription service are not currently available through this website. Additional terms and privacy information will be presented when appropriate before new services begin.

Our Privacy Terms explain cookies and personal information. Selecting ENTER on the cookie notice records the cookie choice described there; it is not a separate signature of these Terms of Use or permission for unspecified future services.

2. Educational information and professional advice

Our stories, questions and resources provide general education about caregiving, family responsibilities, planning and estates. They are not individualized legal, medical, financial, tax or other professional advice, and using the website or emailing us does not create a professional-client relationship.

Circumstances and requirements vary. Discuss decisions, documents, deadlines and care needs with an appropriately qualified professional. Do not delay medical care or rely on this website for an emergency; contact the appropriate emergency service when necessary.

3. Ownership and separate rights

Deere to Innovate, LLC holds the rights it owns in the Fifty And website materials and branding. Other material, including contributor work, third-party material and open-source software, remains subject to its owners' rights and applicable licenses. We do not claim ownership of linked articles or grant rights that we do not hold.

Copyright notices apply to material protected by applicable law. A company notice does not override another owner's rights, an open-source license or an exception provided by law. You may not imply that we or a contributor endorse your organization, product or views without permission.

4. Personal use and sharing

You may read the website and download or print our downloadable materials for your personal, noncommercial use. You may share links and short excerpts from material we own for noncommercial discussion or education if you identify Fifty And, link to the original page, preserve any accompanying credit or copyright notice and do not change the meaning or imply endorsement.

Full republication, redistribution of a complete download, commercial reuse or other use beyond this permission requires our prior written permission unless applicable law or a separate license permits it. Contact hello@fiftyand.com with the material, intended use and proposed audience.

This permission does not cover material identified as belonging to someone else. Follow its owner's terms or obtain the necessary permission. Nothing here limits fair use, public-domain use or other rights that applicable law gives you.

5. Stories and other contributions

Contributors retain ownership of their stories, photos, recordings and other work. Sending an inquiry or material by email allows us to review it and respond to you; it does not grant us a general publication or commercial-use license.

Before publishing or recording a contribution, we will agree separately in writing on the permitted use, editing, credit, channels, timing and any promotional or commercial terms. We do not promise to publish, pay for or return unsolicited material unless we agree otherwise in writing.

Only submit material you are entitled to share. Do not send another person's private records, confidential information or copyrighted work without the necessary authority. Ordinary email is not a suitable way to send sensitive family, health, financial or identity information.

6. Outside articles and other websites

We may link to articles, resources and services published elsewhere. Those publishers retain their rights, control their content and apply their own terms and privacy practices. A link or credit does not grant permission to copy an article, photograph or other protected material, and does not by itself mean that either organization endorses the other.

When we reference outside reporting, we aim to identify the source and link readers to the original. Any summary, quotation, image or republication must have an appropriate legal basis or permission. Our sharing permission applies only to the rights we hold; it does not extend to the source publisher's material.

7. Respectful and lawful use

Do not use the website or contact addresses to send threats, harassment, spam, unlawful material or malicious code; impersonate someone; infringe rights; or disclose another person's private information without authority.

Do not bypass security controls, attempt unauthorized access, disrupt the website or conduct intrusive security testing without written authorization. Do not use automated bulk extraction or republication beyond our permission, an applicable license or what the law allows. Ordinary search-engine indexing and normal use of accessibility tools are permitted.

Send suspected security issues privately to privacy@fiftyand.com with enough information for us to understand the concern. Avoid sending unnecessary personal information or accessing other people's records.

8. Accuracy and availability

We aim to make the website useful and accurate, but information can become outdated and mistakes can occur. We cannot promise that every page is complete, appropriate for your circumstances or continuously available. We may correct, update or remove website material and suspend access to address abuse, security or service issues.

Tell us about a factual error or broken link at hello@fiftyand.com. Verify important information with the relevant original source or qualified professional before acting on it.

9. Rights that remain protected

These terms do not waive mandatory consumer rights or exclude liability that cannot lawfully be excluded. They do not excuse fraud, willful injury or violations of law. Educational notices and information about outside links do not override those protections.

10. California law and San Diego courts

California law governs these terms, subject to mandatory protections that apply to you. Where the law permits, disputes about the website or these terms will be brought in the state or federal courts with jurisdiction in San Diego County, California. This provision does not remove a right to use another court where applicable law requires it.

11. Changes to these terms

We will show the effective date and version when these terms change. Material changes will be highlighted on the website, and we will seek separate acceptance when required. Changes do not retroactively grant publication rights to contributions you previously sent or replace a separate written contributor agreement.

12. Contact and permissions

For website questions, corrections, content permissions or copyright concerns, email hello@fiftyand.com. For a copyright concern, identify the work, the relevant page and your authority to raise the issue so we can review it. For privacy requests or security concerns, email privacy@fiftyand.com.
